elementor - v3.16.0 - 17-10-2023 *\/\n.elementor-heading-title{padding:0;margin:0;line-height:1}.elementor-widget-heading .elementor-heading-title[class*=elementor-size-]>a{color:inherit;font-size:inherit;line-height:inherit}.elementor-widget-heading .elementor-heading-title.elementor-size-small{font-size:15px}.elementor-widget-heading .elementor-heading-title.elementor-size-medium{font-size:19px}.elementor-widget-heading .elementor-heading-title.elementor-size-large{font-size:29px}.elementor-widget-heading .elementor-heading-title.elementor-size-xl{font-size:39px}.elementor-widget-heading .elementor-heading-title.elementor-size-xxl{font-size:59px}<\/style>\n<h2>RETIFICA\u00c7\u00c3O IMOBILI\u00c1RIA<\/h2>\n<h4>O que \u00e9 uma retifica\u00e7\u00e3o imobili\u00e1ria ?<\/h4>\n<p>A retifica\u00e7\u00e3o imobili\u00e1ria \u00e9 a corre\u00e7\u00e3o dos dados,&nbsp; e das informa\u00e7\u00f5es sobre um im\u00f3vel, seja este, um terreno urbano, uma ch\u00e1cara, um lote dentro de um loteamento.&nbsp; Por raz\u00f5es desconhecidas as informa\u00e7\u00f5es presentes na matricula de registro imobili\u00e1rio,&nbsp; possuem n\u00e3o conformidades com a realidade f\u00edsica da propriedade, que dificultam ou impedem a sua comercializa\u00e7\u00e3o,&nbsp; portanto, \u00e9 necess\u00e1rio haver uma&nbsp; a\u00e7\u00e3o de corre\u00e7\u00e3o das informa\u00e7\u00f5es presentes na matr\u00edcula.&nbsp;<\/p>\n<p>A retifica\u00e7\u00e3o \u00e9 um procedimento previsto na Lei 6.015\/1973 e tem por objetivo corrigir omiss\u00f5es, informa\u00e7\u00f5es imprecisas ou que n\u00e3o apresentam a caracter da realidade do im\u00f3vel.<\/p>\n<p>Esse procedimento geralmente \u00e9 feito diante do Registro de Im\u00f3veis onde o bem est\u00e1 registrado, por\u00e9m, \u00e9 poss\u00edvel que ocorra por meio judicial.<\/p>\n<style>\/*! elementor - v3.16.0 - 17-10-2023 *\/\n.elementor-widget-image{text-align:center}.elementor-widget-image a{display:inline-block}.elementor-widget-image a img[src$=\".svg\"]{width:48px}.elementor-widget-image img{vertical-align:middle;display:inline-block}<\/style>\n<p>\t\t\t\t\t\t\t\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"1920\" height=\"1080\" src=\"http:\/\/topochart.com.br\/wp-content\/uploads\/2023\/10\/boundaries.webp\" alt=\"\" loading=\"lazy\" srcset=\"https:\/\/topochart.com.br\/wp-content\/uploads\/2023\/10\/boundaries.webp 1920w, https:\/\/topochart.com.br\/wp-content\/uploads\/2023\/10\/boundaries-300x169.webp 300w, https:\/\/topochart.com.br\/wp-content\/uploads\/2023\/10\/boundaries-1024x576.webp 1024w, https:\/\/topochart.com.br\/wp-content\/uploads\/2023\/10\/boundaries-768x432.webp 768w, https:\/\/topochart.com.br\/wp-content\/uploads\/2023\/10\/boundaries-1536x864.webp 1536w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/p>\n<p>\u00c9 importante observar e esclarecer que essa a\u00e7\u00e3o de procedimento n\u00e3o se limita somente a retifica\u00e7\u00e3o de \u00e1rea.<\/p>\n<p>Por meio da retifica\u00e7\u00e3o imobili\u00e1ria \u00e9\u00a0 poss\u00edvel\u00a0 a corre\u00e7\u00e3o de\u00a0 diversas informa\u00e7\u00f5es, conforme disp\u00f5e o artigo 213, inciso I, da Lei de\u00a0<\/p>\n<p>Registros P\u00fablicos, cabe entender em qual caso a corre\u00e7\u00e3o deve ser conduzida:<\/p>\n<ul>\n<li>A\u00e7\u00e3o de omiss\u00e3o ou erro cometido na transposi\u00e7\u00e3o de qualquer elemento do t\u00edtulo;<\/li>\n<\/ul>\n<ul>\n<li>As confronta\u00e7\u00f5es mant\u00e9m distor\u00e7\u00f5es de medidas e do nome do verdadeiro confrontante (lindeiro);\u00a0 \u00a0 \u00a0<\/li>\n<\/ul>\n<ul>\n<li>Altera\u00e7\u00e3o de denomina\u00e7\u00e3o do nome\u00a0 de logradouro p\u00fablico, comprovada por documento de f\u00e9 publica oficial;<\/li>\n<\/ul>\n<ul>\n<li>Retifica\u00e7\u00e3o para a indica\u00e7\u00e3o de rumos, \u00e2ngulos de deflex\u00e3o\/inser\u00e7\u00e3o de coordenadas georeferenciadas (UTM), em que n\u00e3o haja<\/li>\n<\/ul>\n<p>\u00a0altera\u00e7\u00e3o das medidas perimetrais;<\/p>\n<ul>\n<li>Altera\u00e7\u00e3o ou inser\u00e7\u00e3o que resulte de mero c\u00e1lculo matem\u00e1tico feito a partir das medidas perimetrais constantes do registro;<\/li>\n<\/ul>\n<ul>\n<li>Reprodu\u00e7\u00e3o de descri\u00e7\u00e3o de linha divis\u00f3ria de im\u00f3vel confrontante que j\u00e1 tenha sido objeto de retifica\u00e7\u00e3o;<\/li>\n<\/ul>\n<ul>\n<li>Inser\u00e7\u00e3o ou modifica\u00e7\u00e3o dos dados de qualifica\u00e7\u00e3o pessoal das partes, comprovada por documentos oficiais, ou mediante\u00a0despacho judicial quando houver necessidade de produ\u00e7\u00e3o de outras provas;<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p><b>Para fazer uma retifica\u00e7\u00e3o de \u00e1rea \u00e9 necess\u00e1rio que seja apresentado um requerimento junto ao Cart\u00f3rio de Registro Im\u00f3bili\u00e1rio com a Planta T\u00e9cnica e o Memorial Descritivo do Im\u00f3vel feito por profissional legalmente habilitado incluso a realiza\u00e7\u00e3o do registro da Anota\u00e7\u00e3o de Responsabilidade T\u00e9cnica (ART) no Conselho Regional de Engenharia e Agronomia \u2013 CREA.<\/b><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>RETIFICA\u00c7\u00c3O IMOBILI\u00c1RIA O que \u00e9 uma retifica\u00e7\u00e3o imobili\u00e1ria ?
